This Privacy Policy ("Policy") explains in general terms how Advance Traders (Australia) Pty Ltd ACN 130 664 194 protects the privacy of your personal information. We are firmly committed to protecting the privacy and confidentiality of personal information and maintain robust physical, electronic and procedural safeguards to protect personal information in our care.

What is personal information?

Personal information is information or an opinion, in any form (whether true or not) about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.
How do we collect personal information?

Where practical we will collect personal information directly from you. Generally this will be collected by us when you deal with us either in person, by telephone, letter, facsimile, email or when you visit our website. We may request information about you when you purchase or make enquires about tickets or other products and services; when you enter competitions, register for promotions or when you request brochures or other information. We may also collect information when we invite you to complete surveys or provide us with feedback.
What personal information do we collect?

We collect information that is required for use in the business activities of Advance Traders (Australia) Pty Ltd, including for example, financial details necessary in order to process various transactions and any other information you may elect to provide to us.

We are required by law to obtain your consent to the collection of sensitive information. We will assume that you have consented to the collection of all information which is provided to us for use in accordance with this Policy, unless you tell us otherwise.
When we act as agent

When we sell products and services to you, we usually do so as agent for the wholesaler or provider of those products and services. This means that we usually collect personal information about you, both for our internal purposes, and on behalf of the parties for whom we act as agent, for their internal purposes. Accordingly, the consent you provide under this statement to the collection of personal information by us, applies equally to the parties whose products and services we sell. For example, if you purchase a Advance Traders product, service or membership from us, then under this policy you will have consented to your personal information being used by us.
How do we use personal information?

We will use your personal information to provide you with bicycle and bicycle related products and services.

We may use and disclose your personal information for the purposes for which it was collected, or for a related or ancillary purpose such as any one or more of the following purposes:

    Identification of fraud or error;
    Regulatory reporting and compliance;
    Developing, improving and marketing our products and services;
    Servicing our relationship with you by, among other things, providing updates on promotions and services we think may interest you;
    Involving you in market research gauging customer satisfaction and seeking feedback regarding our relationship with you;
    To facilitate your participation in loyalty programs;
    To analyse trends in sales and products;
    For marketing activities; and
    Internal accounting and administration.

Is the information disclosed to third parties?

We may disclose your personal information:

    as permitted or required by law;
    to various regulatory bodies and law enforcement officials and agencies to protect against fraud and for related security purposes;
    to our third party service providers as well as to our related entities and brands;
    to third parties such as bicycle shops for the purpose for which the information was collected or for a related purpose;
    to third parties who may involve you in market research for the purpose of servicing our relationship with you and improving the services we provide;
    to third parties for the purpose of analysing trends in bicycle sale.

The third parties to whom we disclose your personal information may also be taken to have collected your personal information in their own right, for their internal use. For more information, see the heading above, titled "When we act as agent".

Where we engage third party contractors to perform services for us those third party contractors may be required to handle your personal information. Under these circumstances those third party contractors must safeguard this information and must only use it for the purposes for which it was supplied, although we are not responsible for ensuring this. Other than the above, we will not disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
Trans-Border data flows

In providing our services to you it may be necessary for us to forward personal information to relevant overseas third party service providers. Please let us know if you have any objections to such transfers.

Advance Traders (Australia) Pty Ltd has implemented appropriate physical, electronic and managerial security procedures in order to protect personal information from loss, misuse, alteration or destruction.

Advance Traders (Australia) Pty Ltd regularly reviews security and encryption technologies and will strive to protect information to the fullest extent possible.
Access and correction of personal information

Subject to the exceptions set out in the Privacy Act 1988(Cth), we invite you to access and correct any personal information we may hold on you. If we deny access, we will provide you with the reason for such denial.We may recover from you our reasonable costs of supplying you with access to this information.

Use of cookies

A cookie is a small piece of text that is placed within the memory of a computer and can be later retrieved by web page servers. We use cookies to enhance your interaction and convenience with our website and do not use cookies to record any personal information.

Terms & Conditions

Online Shopping Terms and Conditions

These terms apply to the ordering, purchase and delivery of Goods from the Website, and forms a contract between you and Advance Traders.

These Terms contain important information about the ordering, processing and delivery of Goods, including limitation of liability.

Other important terms may also apply to your Order, such as the Privacy Policy.

 

1. Compliance with Terms

1.1. You will be bound by these Terms each time you submit an Order. Each Order you place will be a separate contract between you and Advance Traders for the supply of Goods.

 

2. Placing Orders & Delivery

2.1. Advance Traders will not be liable to you for loss you or any third party suffers for a delay or failure to process your Order or deliver Goods due to inaccurate or incomplete details provided in an Order.

2.2. If you place consecutive or separate Orders, we cannot consolidate your Orders. A separate Delivery Fee, if applicable, will apply to each Order. Subject to any applicable quantity restrictions, you can order as many Goods as you wish in one Order.

2.3. Advance Traders reserves the right to accept or reject your Order for any reason at any time. If Advance Traders rejects your Order you will receive a refund or credit of any money paid.

2.4. In an effort to keep freight to a minimum, our ongoing priority is to ensure the right items are in the nearest warehouse to your store. Our aim is to ensure that volume sellers are split between all Advance Traders warehouses. Freight rates apply to metro delivery zones. Shops out of metro freight zones will receive a customised freight rate structure.

2.5. If your order cannot all be supplied from one central warehouse, your order may be split and multiple freight charges will be applicable. You will be notified of the split warehouse delivery in the final step of purchase.

 

3. Availability of Goods

3.1. From time to time, some Goods may be out of stock or are unavailable and we may not be able to fulfil all or part of your Order. If this happens, you order will be Backordered and fulfilled when stock is once again available.

3.2. We may withdraw or suspend from sale any Goods displayed on the Website, either temporarily or permanently, at any time. Advance Traders will not be liable to you for any loss you or any third party suffer as a result of a withdrawal or suspension of sale of a particular Good.

3.3. Where a Good which is the subject of an Order has been withdrawn or suspended from sale and your payment for the Good has already been processed, we will refund any money paid to us under clause 7.

3.4. Advance Traders reserves the right not to honour any incorrect offers represented on the Website made by genuine human or system error. Where your Order is affected by an error on the Website (for example, in a description, an image, Price or otherwise), we will reject that part of the Order affected by the error. You will be refunded/credited the value of that part of your Order affected by the error, under clause 7, and Advance Traders will fulfil the remainder of your Order. If you are not satisfied with the partial fulfilment of your Order, you can return your Order to us under the Returns Policy.

3.5. If your Order is affected by a genuine error (including in a description, an image or a Price), we reserve the right to cancel your Order and refund/credit any money paid to us.

3.6. You acknowledge and agree that:

  1. all pictures and images of Goods displayed are for illustrative purposes only;
  2. any accessory featured with the Goods is for illustrative purposes only, and may be sold separately; and
  3. where we provide dimensions and measurements in the description of a Good, the dimensions may vary slightly in real life, and it is your responsibility to ensure that the actual size of each Good is suitable for your purpose prior to submitting your Order

 

4. Price and payment

4.1. When you place an Order, we will charge you or raise and invoice on your account and you agree to pay the Price and any applicable Delivery Fee.

4.2. All Prices are in Australian Dollars and, if GST applies, inclusive of GST. Any fees and charges (including Delivery Fees) imposed by these Terms also include GST where applicable.

4.3. Advance Traders reserves the right to change or alter Prices without notice to you. If you have already submitted an Order at a particular Price, we will endeavour to supply your Goods at that Price (unless your Order is affected by a pricing error, in which case clause 3.4 will apply).

4.4. Payment methods are specified on the Website at the time you place your Order. The name on any credit card used for payment must match the name on the Order.

4.5. Any payment for an Order must be cleared by Advance Traders before Goods are dispatched. If your payment cannot be processed, your Order will be rejected and you will be notified of this by an Advance Traders employee. If a credit card payment cannot be processed you should contact your card issuer to try to resolve the problem, or use an alternative payment method in order to continue with your Order.

4.6. In paying or attempting to pay for Goods, you agree that you have not engaged in any fraudulent conduct or contravened any Law.

4.7. Lay-by is not available for Orders.

4.8. Pricing is Wholesale pricing, delivery charges and costs may vary across retail outlets and geographic locations.

4.9. Advance Traders uses SSL, does not store credit card details, and all payments are handles by a secure, PCI compliant third party.

 

5. Order cancellations and returns

5.1. Dealers must obtain an authorisation number from Advance Traders HQ in order to return product. Returning product, due to no fault of Advance Traders, will incur a 5% warehouse handling charge plus actual return freight cost from the Courier invoice.

5.2. If we cannot contact you about your Order using the contact details you provided in the Order, after having made reasonable attempts to contact you, we will leave your order in our system until we are notified.

5.3. Delivery Fees will not be refunded if you return Goods for change of mind or you made an incorrect selection, including if you ordered the incorrect size, colour etc.

5.4. Goods can only be returned in accordance with these Terms and the Returns Policy. The Returns Policy forms a part of these Terms.

5.5. If the original payment was made:

  1. on a credit card, refunds will be processed on the same card as the original payment was made.
  2. refunds will be processed on the same card as the original payment was made first.
  3. Return card for remaining amount will be emailed to the email address entered at the time you place your order.

5.6. Shortages or damage must be reported within 5 days of receipt of shipment. Please remember to check for signs of shipping/ transit damage before opening the box. Unless damaged in transit, bikes can only be returned if the box has not been opened and the bike not removed, unpacked or assembled

 

6. Product Recalls

6.1. If a Good is subject to a product recall, a notice will be posted in the Product Recall notice section of the Website.

6.2. You consent to us contacting you using the personal information provided on your Order, to notify you of a product recall by telephone, email, or SMS.

 

 

7. Privacy

7.1. Personal Information, which you provide to us during the Order process including contact details, will be kept, used and disclosed by us in accordance with Advance Traders Privacy Policy for the purpose of processing and delivering your Order

7.2 .We may also collect, and our third party providers of advertisements and content may collect, location and other information such as the URL or advertisement you came from or linked to, IP address, browser type, pages you visited from the Website etc.

7.3. Unless otherwise indicated in your account settings or at the time you placed your Order, Advance Traders may send you marketing information

7.4. If you wish to change or update your online account information (including your email address, password or communication preferences), click on the Account Overview section on this website.

7.5. Advance Traders reserves the right to conduct and implement fraud detection processes, including without limitation to validating your credit card details.

 

8. Risk & Liability

8.1. Risk and title in the Goods passes to you on the date and time of delivery of the Goods by the Delivery Agent or when Goods are delivered.

8.2. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

8.3. You represent and warrant to Advance Traders that Advance Traders will not be liable for any expense or injury (including indirect loss such as loss of revenue, profits, anticipated savings, goodwill or business opportunity, injury to your reputation) in contract, tort, under statue or otherwise, howsoever caused including arising directly or indirectly from or in connection with these Terms.

8.4. Our liability to you for loss or damage of any kind arising out of these Terms will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

 

9. Termination

9.1. We may, at our discretion, terminate the agreement for the supply of Goods to you:

  1. for convenience, at any time, on giving notice to you; or
  2. immediately if Advance Traders reasonably believes that you have breached these Terms and:
  3. that the breach is not capable of remedy; or
  4. if you have been provided with notice of the breach, and you have failed to remedy that breach within 14 days (where the breach is able to be remedied)

 

10. General

10.1. We reserve the right at all times to make changes to Advance Traders Terms. Any variations to these Terms will take effect from posting on the Website. The Terms which apply at the time you place an Order are those that govern that Order.

10.2. Any provision of these Terms that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions of these Terms or affect the validity or enforceability of that provision in any other jurisdiction.
